Notice of Privacy Practices

Effective Date: September 17, 2026  ·  Last Updated: September 17, 2026

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Our Commitment to Your Privacy

AC Personal Care LLC ("AC Personal Care," "we," "us," or "our") is dedicated to maintaining the privacy of your protected health information ("PHI"). In the course of providing personal care services, we create records about the care and services we provide you. This notice applies to those records, whether created by our staff or by others involved in your care.

We are required by the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") to maintain the privacy of your PHI, to provide you with this notice of our legal duties and privacy practices with respect to PHI, and to abide by the terms of this notice while it is in effect.

2. How We May Use and Disclose Your Health Information Without Your Authorization

The following categories describe ways we may use and disclose your health information. Not every possible use or disclosure is listed, but all the ways we are permitted to use and disclose information fall within one of these categories.

For Treatment

We may use and disclose your health information to provide, coordinate, or manage your care and related services, including coordinating your care with other caregivers, family members you designate, or other healthcare providers involved in your treatment.

For Payment

We may use and disclose your health information so that the services you receive may be billed to and payment collected from you, an insurance company, Nevada Medicaid, or a third party. This may include determining eligibility, coverage, and prior authorization for services.

For Health Care Operations

We may use and disclose your health information for our operations, including quality assessment and improvement activities, staff training and supervision, licensing and accreditation activities, and business planning.

Appointment & Service Reminders

We may use and disclose your health information to contact you as a reminder of a scheduled visit or to tell you about care options.

Individuals Involved in Your Care

We may disclose your health information to a family member, relative, close friend, or other person you identify who is involved in your care, or to notify such a person of your location or condition, unless you object.

As Required by Law

We will disclose your health information when required to do so by federal, state, or local law, including reporting to Nevada Medicaid or other regulatory authorities.

Public Health & Health Oversight Activities

We may disclose your health information to public health authorities for purposes such as preventing disease, and to health oversight agencies (such as Nevada Medicaid auditors or licensing surveyors) for activities authorized by law, including audits, investigations, and inspections.

Abuse, Neglect, or Domestic Violence

As a personal care agency, we are a mandatory reporter. We may, and in some cases must, disclose your health information to appropriate authorities if we reasonably believe you are a possible victim of abuse, neglect, or domestic violence.

Judicial and Administrative Proceedings

We may disclose your health information in response to a court or administrative order, subpoena, discovery request, or other lawful process, under certain circumstances.

Law Enforcement

We may disclose health information to law enforcement officials for purposes such as identifying a suspect, fugitive, witness, or missing person, and in compliance with a court order, warrant, or similar legal process.

To Avert a Serious Threat to Health or Safety

We may use and disclose your health information when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person.

3. Uses and Disclosures Requiring Your Written Authorization

Other uses and disclosures of your health information not described in Section 2 — including, in most cases, the sale of your health information or its use for marketing purposes — will be made only with your written authorization. You may revoke that authorization, in writing, at any time, except to the extent we have already taken action in reliance on it.

4. Your Rights Regarding Your Health Information

Right to Inspect and Copy

You have the right to inspect and obtain a copy of health information we use to make decisions about your care, with limited exceptions. Requests must be submitted in writing to our Privacy Officer.

Right to Request Amendment

If you believe information in your record is incorrect or incomplete, you may ask us to amend it for as long as we maintain the information. We may deny your request under certain circumstances.

Right to an Accounting of Disclosures

You have the right to request a list of certain disclosures we have made of your health information, other than disclosures for treatment, payment, health care operations, and certain other exceptions.

Right to Request Restrictions

You have the right to ask us to limit how we use or disclose your health information for treatment, payment, or operations. We are not required to agree, except where you have paid for a service in full out-of-pocket and ask that we not disclose that information to your health plan.

Right to Request Confidential Communications

You have the right to ask that we communicate with you about your care in a specific way or at a specific location (for example, by phone rather than mail). We will accommodate reasonable requests.

Right to a Paper Copy of This Notice

You have the right to a paper copy of this notice at any time, even if you agreed to receive it electronically.

Right to Be Notified of a Breach

You have the right to be notified if we discover a breach of your unsecured protected health information.

5. Our Responsibilities

  • We are required by law to maintain the privacy of your health information and to provide you with this notice.
  • We must abide by the terms of this notice currently in effect.
  • We reserve the right to change the terms of this notice and to make the revised notice effective for health information we already have as well as any information we receive in the future.

6. Changes to This Notice

If we make a material change to this notice, we will post the revised notice on our website with a new effective date, and make paper copies available at our office upon request.

7. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services.
